YooAccess App - Terms & Conditions

1. Definitions

1.1 "User"

Refers to any tenant, owner, resident, or authorized individual granted access to use the YooAccess App.

1.2 "Guest"

Refers to any visitor invited by the User and granted access through the YooAccess App.

1.3 "YooAccess App"

Refers to the ParkPoint access management platform, including all mobile applications, web portals, QR-based systems, and related interfaces used for property and parking access.

2. Use of the YooAccess App

2.1 License Grant

ParkPoint grants the User a limited, non-exclusive, non-transferable license to use the YooAccess App solely for managing guest access to designated properties and parking facilities.

2.2 User Responsibility

The User shall ensure that access credentials are used only by authorized individuals and shall remain fully responsible for all activities conducted under their account.

2.3 Guest Access Passes

The User may generate digital access passes (QR codes or equivalent) for Guests to access the property or parking areas.

2.4 Accurate Information

The User is responsible for ensuring that all information provided for guest access is accurate and complete.

2.5 Prohibited Uses

The User shall not use the YooAccess App for any unauthorized, unlawful, or misleading purposes.

3. Guest Access & Entry

3.1 Guest Access Methods

Guests may access the property using a valid QR code or through manual registration by on-site security personnel.

3.2 Verification and Security

ParkPoint and property management reserve the right to verify guest identity and restrict access where necessary for security reasons.

3.3 Time-Bound Access

Access granted to Guests is time-bound and limited to the permissions defined by the User or property management.

3.4 Misuse of Privileges

Any misuse of guest access privileges may result in immediate revocation of access.

4. Monitoring, Compliance, and Security

4.1 Access Monitoring

ParkPoint reserves the right to monitor all access activity, including QR usage, guest entries, and system interactions for security and operational purposes.

4.2 Misuse Detection

Any misuse, duplication, or unauthorized sharing of access passes may result in suspension or termination of access rights.

4.3 Compliance

The User agrees to comply with all property-specific rules, security policies, and access protocols.

5. System Changes, Maintenance, and Updates

5.1 Platform Modifications

ParkPoint may modify, upgrade, suspend, or discontinue any feature of the YooAccess App at its discretion, with or without prior notice.

5.2 System Downtime

ParkPoint shall not be liable for temporary interruptions, technical issues, or system downtime due to maintenance or unforeseen circumstances.

5.3 Acceptance of Changes

Continued use of the App constitutes acceptance of any updates or modifications.

6. Liability, Indemnity, and Limitations

6.1 Limitation of Liability

ParkPoint shall not be liable for any loss, damage, or claims arising from: a) unauthorized or incorrect guest access created by the User, b) misuse or sharing of QR codes or access credentials, c) errors in guest details entered by the User, d) failure of the User to follow security protocols.

6.2 Indemnification

The User agrees to indemnify and hold harmless ParkPoint, its affiliates, and employees from any claims, damages, or liabilities arising from misuse of the YooAccess App.

6.3 Consequential Damages

ParkPoint shall not be liable for indirect, incidental, or consequential damages arising from use of the App.

7. Data Protection and Confidentiality

7.1 Data Collection

ParkPoint may collect, store, and process user and guest data for operational, security, and compliance purposes.

7.2 User Data Handling

The User shall ensure that all guest data is handled responsibly and in accordance with applicable data protection laws.

7.3 Confidentiality

All system access credentials and operational data must be treated as confidential.

8. Termination

8.1 Termination Rights

ParkPoint reserves the right to suspend or terminate access to the YooAccess App at its sole discretion in case of misuse, security concerns, or breach of these Terms.

8.2 Access Revocation

Upon termination, all active and pending access passes may be revoked without notice.

9. Acceptance of Terms

9.1 User Confirmation

By accessing or using the YooAccess App, the User confirms that they have read, understood, and agreed to these Terms & Conditions.

9.2 Continued Use

Continued use of the YooAccess App constitutes acceptance of any amendments to these Terms.
